General Terms and Conditions (GTC)

For orders placed with Victoria Pharmaworld AG - Wholesale (hereinafter Victoria Pharmaworld (www.pharmaworld.com)). Victoria Pharmaworld has all the necessary authorizations to trade in medicines and medical products in accordance with Swissmedic guidelines. For customers who place their orders through Victoria Pharmaworld, the following General Terms and Conditions (GTC) apply. We reserve the right to make changes to these general terms and conditions at any time. With successful use of services of Victoria Pharmaworld, the present general trading conditions are considered as accepted. Medicines within the meaning of the Swiss Therapeutic Products act can only be supplied to institutions authorized to receive them.

1. subject matter of the contract

Victoria Pharmaworld sells the specified products to the customer to the following delivery and sales conditions (GTC).
In any case, these terms and conditions form an integral part of the contract of sale. As soon as the customer has placed the order, the purchase contract is binding. By sending an order, the customer confirms the authorization to purchase medicines.

2. terms of payment

A customer order is usually placed after prior quotation by Victoria Pharmaworld. The prices on the day of ordering are valid, subject to price changes by the manufacturer up to the date of the distribution.
For customers in Switzerland the legal value added tax is included in the offered price. For customers abroad, it is pointed out that local taxes such as VAT and customs duties etc. are not included in our offer. Compliance with local customs regulations is the responsibility of the customer. The listed prices are subject to the condition that no database errors have occurred. Orders placed are binding for the customer, the prices offered are exclusive of shipping charges. These are shown separately.
Payment is usually made, unless otherwise agreed, after receipt of order by payment in advance (credit card, bank transfer).
Victoria Pharmaworld reserves the right not to accept and execute orders without giving reasons. In such a case, the customer will be notified immediately.

3. range of products

Victoria Pharmaworld is a pharmaceutical wholesaler certified by Swiss Health authority Swissmedic and has a quality assurance system (ISO 9001:2015) which ensures that the products distributed come from safe sources, from certified suppliers and manufacturers.
Victoria Pharmaworld provides the best expiration date available from the manufacturer when ordered.
All information about the goods that the customer receives is based on the information provided by the manufacturer. The product description, respectively the package insert of the offered products are usually in GERMAN LANGUAGE. Deviations are possible in individual cases.

4. delivery conditions

Unless otherwise agreed, deliveries shall be taken at risk of the buyer. In the absence of any agreement to the contrary, the risk shall pass to the buyer as soon as we hand over the goods to the forwarding agent, carrier or other person designated to carry out the shipment. If the shipment is delayed due to circumstances beyond our control, e.g. at customs, or if the buyer does not accept the goods in time although they were offered to him, the risk shall pass to the buyer upon receipt of notification that the goods are ready for collection.
After confirmed order, the products will be delivered as soon as possible to the address indicated by the customer. In case of incomplete or incorrect address information, Victoria Pharmaworld declines any responsibility if the product does not reach the recipient in time.
No refunds will be given for shipments that cannot be delivered to the customer. It is the responsibility of the customer to arrange for delivery by the carrier (post office, courier company).
Refrigerated goods will be shipped in consultation with the customer. The customer is responsible for obtaining the appropriate import documents - in case of delays, e.g. at customs, Victoria Pharmaworld cannot be held accountable.
Partial deliveries are permissible. The average delivery time for deliveries within Switzerland is about 3-4 working days, for shipments abroad about 7-14 working days.
If a product ordered is no longer available at the time of delivery, Victoria Pharmaworld reserves the right to cancel the order after informing the customer.
Unforeseen delivery obstacles, such as force majeure, strike, operational disturbances in the own enterprise or in that of the pre-supplier, transport difficulties etc., can delay the supply, entitle the customer however not from the obligatory order to take distance. If the delay lasts longer, an amicable solution will be attempted between the customer and Victoria Pharmaworld.

5. return right

The return of purchased goods is generally excluded.
An exchange of defective goods, e.g. due to production errors of the manufacturer, can take place only after previous arrangement with Victoria Pharmaworld.
There is no obligation to make a replacement delivery if the supplier is not responsible for the deficiency, in particular in case of damage to the goods by the customer or the customs authority.
Refrigerated goods cannot be returned and an expiry date of less than 12 months must be accepted by the customer at the time of ordering.

6. warranty for defects and liability

A damage of the goods must be claimed within 5 days after receipt of the delivery. (Victoria Pharmaworld +41 44 887 02 02 or e-mail info@pharmaworld.com).
The supplied commodity remains property of Victoria Pharmaworld up to the fulfillment of all requirements against the customer from the entire business relation to which it is entitled. For customers from abroad, it is pointed out that the local customs regulations are to be kept and Victoria Pharmaworld cannot take over any responsibility, should the ordered product be held up by the customs. This applies in particular also with the dispatch of refrigerated goods.
For customers in Switzerland the legal value added tax is included in the published price, for customers abroad it is stated that local taxes such as value added tax and customs etc. are not included in our offer. The shipping risk is borne by the customer, the responsibility is transferred to the customer as soon as the goods are handed over to the transport company. If the goods are delivered damaged or incomplete, the transport company must be notified immediately with documentation of the damage (including packaging). We will try to find an accommodating solution with the transport company regarding replacement.

7. data protection

The customer agrees that his data will be stored and processed within the framework of the business relationship. Data will not be passed on to third parties. The customer agrees without express counter report to be informed by Victoria Pharmaworld about new products and services if necessary.

8 Intellectual property

Victoria Pharmaworld (www.pharmaworld.com) reserves all rights (copyright) for any design, text, graphics on its website. Copying or any other reproduction, of the whole website or parts of this website is allowed only for the purpose of placing an order with pharmaworld.com. The pharmaworld.com name, all page headers, navigation bars, graphics and button icons are registered trademarks, brands or proprietary marks. All other trademarks, product names, company names or logos cited on this website are the sole property of their respective owners. Before their passing on to third parties the customer requires the express written agreement of Victoria Pharmaworld.

9. place of jurisdiction and applicable right

Our business activity is based exclusively on Swiss right. Place of jurisdiction is Zurich.

10. final regulations

Victoria Pharmaworld reserves itself at any time changes of these general trading conditions.
